1. Acceptance of Terms

By accessing or using SafeMonk ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

SafeMonk is a secure secret sharing service that allows users to encrypt and share sensitive information with automatic destruction capabilities. The Service uses client-side encryption to protect user data.

3. Acceptable Use Policy

You agree NOT to use the Service to:

• Upload, store, or share illegal content or content that violates any applicable laws
• Upload, store, or share pornographic, obscene, or sexually explicit material
• Upload, store, or share malicious software, viruses, or harmful code
• Share content that infringes on intellectual property rights of others
• Share content that contains personal information of others without consent
• Use the Service to harass, threaten, or harm others
• Attempt to circumvent security measures or gain unauthorized access
• Use the Service for any commercial purposes without authorization
• Share content that promotes violence, terrorism, or illegal activities
• Upload excessively large files or abuse system resources

4. Security and Encryption

• Encryption is performed client-side using AES-GCM with 256-bit keys
• We do not have access to your encryption keys or unencrypted data
• However, we cannot guarantee absolute security against all threats
• You are responsible for securely sharing links and passphrases
• We recommend using this service only for appropriate sensitive data

5. Data Retention and Destruction

• Text secrets are destroyed when view limits are reached or upon expiration
• Files are destroyed after successful download or upon expiration
• We run automated cleanup processes to remove expired data
• Once destroyed, data cannot be recovered by anyone, including us
• We may retain anonymous usage statistics and logs for operational purposes

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEMONK AND ITS OPERATORS SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Damages resulting from security breaches, hacking, or unauthorized access
• Damages resulting from encryption failures or vulnerabilities
• Damages resulting from service interruptions or downtime
• Any damages exceeding $100 USD in aggregate

7. Privacy

We are committed to protecting your privacy:

• We do not collect personal information beyond what's necessary for service operation
• We do not have access to your encrypted data or encryption keys
• We may collect anonymous usage statistics and IP addresses for security purposes
• We do not sell, rent, or share your information with third parties
• We may be required to cooperate with law enforcement under valid legal process

8. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service
• We may suspend or terminate the service at any time with or without notice
• We may implement usage limits or restrictions to ensure fair use
• Scheduled maintenance may temporarily interrupt service

9. Termination

We reserve the right to terminate or suspend access to the Service immediately, without prior notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Suspected illegal or harmful activity
• Abuse of system resources
• At our sole discretion for operational reasons

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the service is operated, without regard to conflict of law principles.
